Terms & Conditions
Last updated: 9 June 2026
These terms and conditions apply to all bookings made directly with La Molineta, a collection of four privately-owned holiday villas in the hills above Frigiliana, Málaga, Spain. By making a booking you confirm that you have read, understood, and accepted these terms.
1. Who we are
La Molineta is owned and operated by the Wakefield family. Our registered address is La Molineta, Frigiliana, 29788 Málaga, Spain. You can reach us at info@molineta.com. Each villa is registered as licensed tourist accommodation in Andalucía; the relevant licence reference is shown on each villa's listing.
2. Making a booking
A booking is confirmed once we have accepted your reservation and you have made the required payment (see section 3). At that point a binding contract is formed between you (the lead guest) and us. The lead guest must be at least 18 years old and is responsible for all members of their party. You agree to provide accurate booking and guest information; Spanish law requires us to register the details of all guests with the authorities (see our Privacy Policy).
3. Prices and payment
Our rates are set in euros (EUR) and include the amenities listed on each villa's page. At checkout you may choose to pay in your own currency, converted at the live exchange rate. Payments are processed securely by Stripe; we never see or store your card details.
- If your stay is less than 3 months away, the full amount is payable at the time of booking.
- If your stay is 3 or more months away, a 50% deposit is payable at booking to secure your dates, and the balance is due within 14 days of our payment request, which we send approximately 3 months before arrival.
- If the balance is not paid by its deadline, the booking will be cancelled, the dates released, and the deposit forfeited (see our Cancellation & Refund Policy).
4. Your stay
- Check-in is from 4:00 PM and check-out is by 10:00 AM, unless otherwise agreed.
- The number of guests must not exceed the maximum occupancy stated for the villa, and the property may only be used for holiday accommodation.
- Parties, events, and commercial use are not permitted. Pets are not allowed at any villa.
- You are responsible for the property during your stay and for any loss or damage caused by you or your party beyond fair wear and tear.
- Pools are not separately fenced. Children must be supervised at all times. Use of the pool and grounds is at your own risk.
5. Cancellations and refunds
Cancellations, refunds, and changes are governed by our Cancellation & Refund Policy, which forms part of these terms.
6. If we have to cancel
In the unlikely event that we must cancel your booking due to circumstances beyond our control (for example, damage to the property or events amounting to force majeure), we will offer alternative dates where possible or a full refund of all sums paid. Our liability in such cases is limited to the amount you have paid us.
7. Liability
We are not liable for any loss, injury, or damage to you or your party, or to your belongings, during your stay, except where caused by our negligence and to the extent required by law. We strongly recommend that all guests hold adequate travel and personal insurance. Nothing in these terms limits liability that cannot be excluded under Spanish law.
8. Complaints
If anything is not right during your stay, please tell us as soon as possible so we can put it right. Contact us at management@molineta.com.
9. Governing law
These terms are governed by Spanish law, and any dispute will be subject to the jurisdiction of the courts of Málaga, Spain. This does not affect any mandatory consumer protection rights available to you under the law of your country of residence.
10. Changes to these terms
We may update these terms from time to time. The terms in force at the time of your booking are those that apply to your stay.
